This document constitutes an offer by Smart Advertising Systems LLP to conclude a contract for paid access to ADVIN's professional features on the terms set out below.
1. Provider and scope of the Offer
1.1. Provider: Smart Advertising Systems LLP, BIN 260640021998, address: Republic of Kazakhstan, Astana, Syganak street, building 47, floor 8, office 16, postal code 010000 (hereinafter "ADVIN").
1.2. The Offer is intended for Providers and Designers who use ADVIN in connection with business or professional activity.
1.3. Terms are used with the meanings given in the User Agreement. The Offer governs only payment for the ADVIN Subscription and does not apply to settlements under an Order Contract between Users.
2. Acceptance and conclusion of the contract
2.1. Before payment, the User sees the selected plan, categories, features, price, currency, term, start date, the presence or absence of auto-renewal, and the refund terms.
2.2. The contract is concluded when the User ticks a checkbox accepting the Offer, which is not pre-selected, and makes a confirmed payment or performs another action expressly indicated by the interface.
2.3. ADVIN records the edition of the Offer, the plan, price, date, time, Account and payment identifier.
2.4. If the User acts on behalf of an organisation, they confirm their authority and the accuracy of the payment details.
3. Subject matter
3.1. For the term of the Subscription, ADVIN provides access to the categories of Orders and professional features specified before payment, and the User pays for that access.
3.2. The specific set of features is determined by the plan card. A feature not specified before payment is not deemed included.
3.3. The Subscription does not guarantee:
- any particular number of Orders, Responses, views or jobs;
- that a Customer will select the User;
- the conclusion of an Order Contract;
- income, return on investment, or the absence of competitors;
- that every Order will match the User's specialisation;
- a constant, equal volume of demand.
3.4. ADVIN does not take a commission from an Order Contract and does not accept payment for an order.
4. Plan, price and term
4.1. The User may choose one or several categories, a package or another plan shown in the interface. The price of each item, the total amount, the currency, the term, the composition of access and the charging frequency are shown before payment and form part of the contract.
4.2. The price is stated in tenge inclusive of applicable taxes, or with a clear statement of how they are calculated.
4.3. The Subscription starts upon confirmation of successful payment and runs for the period selected and shown before payment.
4.4. If auto-renewal was shown to the User before payment and the User expressly enabled it, the Subscription renews automatically for each following period until it is disabled. Before enabling, the composition of the Subscription, the amount, the frequency, the date of the next charge and the way to disable it are shown.
4.5. When paying via Halyk ePay, several selected categories may be paid for in a single operation. On auto-renewal the total amount equals the sum of the active items shown before the charge.
4.6. The User may disable auto-renewal for the whole Subscription or for one or several of its items, where the plan provides for such composition. A disabled item remains available until the end of its paid period but is not included in the next charge. The remaining items continue.
4.7. Adding an item within the current period may be charged pro rata for the remaining term, provided that such amount and the common renewal date are shown before payment.
4.8. A Subscription purchased through the Apple App Store is auto-renewable and renews until it is cancelled in Apple Account settings. Price, period, switching between products, cancellation and refunds are also governed by Apple rules. Changing the set of categories may require switching to a different App Store product.
4.9. Not using the Account, the absence of suitable Requests or a voluntary decision not to send Responses neither suspend nor extend the term of the Subscription.
5. Payment
5.1. Payment is made by the method shown in the interface: via Halyk ePay, or via the Apple App Store payment system or another provider indicated before payment.
5.2. ADVIN does not store the full card number, CVV or other data that must be processed by the payment provider.
5.3. The payment obligation is deemed performed once the provider has confirmed the payment and the funds have been credited to, or guaranteed to be made available to, ADVIN.
5.4. The User is provided with the payment or accounting document prescribed by law.
5.5. Bank errors, card restrictions and third-party fees are governed by their own terms, but ADVIN assists in checking the payment status within the limits of the information available.
5.6. The terms of the payment system or app store may additionally govern the execution of the payment, management of the Subscription and the technical refund procedure. They do not diminish the User's mandatory rights or ADVIN's liability for its own service.
6. Activation and access
6.1. Access is activated without undue delay after payment is confirmed.
6.2. The User checks the plan and categories immediately after activation and reports any error to support@advin.kz.
6.3. Scheduled maintenance is carried out with minimal impact where possible. A short interruption that does not deprive the User of a substantial part of the paid access does not in itself give rise to a right to a full refund.
7. Suspension and blocking
7.1. Where a breach is suspected, ADVIN may temporarily restrict access for the duration of the review. If access is substantially restricted and the breach is not confirmed, the term of the Subscription is suspended or extended by the corresponding period.
7.2. Where a restriction was applied in error, access is restored and the term is extended in proportion to the actual restriction.
7.3. Where a substantial or repeated breach of the User Agreement or the Rules is confirmed, ADVIN may terminate the Subscription. The fee for the period during which access was provided, and losses arising from voluntary non-use, are not refunded.
7.4. Where an Account is blocked for a breach, the unused portion is not refunded to the extent permitted by law. Mandatory rights that cannot be excluded by contract are preserved.
8. Cancellation and refunds
8.1. The User may disable auto-renewal before the date of the next charge. For a composite Subscription an individual item may be disabled where the plan so provides. Disabling stops future charges but does not terminate access until the end of the period already paid for, and does not in itself create a right to a refund for that period.
8.2. The mere absence of use, of suitable Orders, of selection by a Customer, or of the expected income does not constitute a defect in the service and does not give rise to a right to a refund.
8.3. If ADVIN has not activated the Subscription, has erroneously charged an amount twice, or is unable to provide a paid feature for reasons attributable to it, the User may demand rectification, a proportionate extension, a substitute, or a refund for the period actually not provided.
8.4. Where mandatory law grants the User the right to terminate the contract and claim a refund, the calculation takes into account the access actually provided, lawful costs and mandatory requirements.
8.5. A request is sent to billing@advin.kz and includes the Account, plan, date, amount, payment identifier, reason and confirmation of authority. Full card details are not requested.
8.6. A refund is made by the original method or by another lawful method after verification, within the period established by law and by the payment provider's rules.
9. Changes to plans
9.1. A new price does not apply retroactively to a period already paid for.
9.2. A change to the composition of a paid plan must not deprive the User of its substantial value. Where a substantial feature is discontinued without any breach by the User, an equivalent substitute, an extension, or a refund for the period not provided is offered.
9.3. The terms of the new period are shown before the next payment.
10. User obligations
The User undertakes to:
- pay for the Subscription using a lawful means of payment;
- not transfer access and not create duplicate Accounts;
- not circumvent categories, quotas and restrictions;
- provide accurate details;
- independently discharge their tax and professional obligations;
- comply with the User Agreement and the Rules.
11. Liability
11.1. ADVIN is responsible for providing the paid technological access, but is not responsible for Customers' decisions or the outcomes of external Order Contracts.
11.2. A party is released from liability for non-performance due to force majeure within the limits of the law, but shall notify the other party and take reasonable steps to mitigate the consequences.
11.3. The limitations do not apply to wilful breach, gross negligence, or liability that cannot be excluded by law.
12. Complaints and disputes
12.1. A complaint is submitted through an official channel and is considered in the manner and within the time limits set out in the ADVIN Procedure for Enquiries and Complaints and in the mandatory legislation of the Republic of Kazakhstan. A special mandatory time limit takes precedence.
12.2. The User attaches information about the payment and the claim. ADVIN may not require data that is not necessary for verification.
12.3. The legislation of the Republic of Kazakhstan applies. Mandatory jurisdiction and Consumer rights are preserved where the person concerned qualifies as a Consumer under the law.
13. Amendment and termination of the Offer
13.1. A new edition applies to new payments. The edition accepted at the time of payment applies to the current period, except for mandatory changes required by law or improvements that do not worsen the User's position.
13.2. ADVIN may discontinue the sale of a plan while preserving access already paid for, or by providing the compensation set out in section 9.

13.3. The Kazakh and Russian versions of the Offer have equal force. The English version is provided for convenience; in the event of a discrepancy, the version in the language prescribed by mandatory legislation shall apply.
